Petitioner apprehends his arrest in connection with Hasanpur (Bithan) P.S.Case No. 189 of 2004, Trial No. 383 of 2017, registered for the offences punishable under Sections 376, 511 and 379 of the Indian Penal Code.

Allegation against the petitioner is that he tried to commit rape upon the informant.

Submission of learned counsel for the petitioner is that police after investigation has submitted final form not finding case true but learned Magistrate has taken cognizance after nine years of the occurrence and petitioner has no knowledge of the same. Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.30455 of 2018 (3) dt.06-07-2018 2/2 circumstances, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the 1st Additional Sessions Judge, Samastipur, in connection with Hasanpur (Bithan) P.S.Case No. 189 of 2004, Trial No. 383 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
