====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 23-04-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Lalganj P.S. Case No. 371 of 2018, instituted for the offence under Section(s) 30(a), 32(2) and 41(1) of Bihar Prohibition & Excise Act, 2016. It is alleged in the written report that 2579.720 litres of foreign liquor has been recovered from the house of Harendra Singh. It is further alleged that Harendra Singh told before the Police that aforesaid foreign liquor has been brought in his house by Awdhesh Singh, Sanjay Singh and Sonu Singh. Police raided the house of Awdhesh Singh (petitioner) and recovered 365.190 litres of foreign liquor.

The Seizure list which is part of the First Information Report does not bear signature of the petitioner rather it bears

Counsel for the petitioner submits that Harendra Singh and Punam Devi have already been granted bail by coordinate Bench of this Court vide orders dated 11.01.2019 and 10.01.2019 passed in Cr. Misc. 79602 of 2018 and 77196 of 2018 respectively.

Petitioner is in custody since 26.3.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge, Excise Act, Vaishali, in connection with Lalganj P.S. Case No. 371 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
