2. The petitioners are in custody in connection with Fulkaha P.S Case No. 158 of 2023 registered for the offences punishable under Sections 302/34 of the I.P.C.
3. As per prosecution case, it is alleged that petitioners along with other assaulted the son of the informant and killed him.
4. Learned counsel for the petitioners submits that petitioner has falsely been implicated in this case. It is further submitted that petitioners have got no criminal
Patna High Court CR. MISC. No.30282 of 2024(2) dt.24-04-2024 2/2 antecedents. It is also submitted that petitioner is in judicial custody since 23.11.2023.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. On perusal of the FIR, impugned order it appears that allegation against the petitioners are only to assault the son of the informant while not to kill the son of the informant, no any external injury mentioned in the postmortem report and also considering the aforesaid facts and circumstances of the case and submissions made on behalf of the petitioners, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M 1st Class, Araria in connection with Fulkaha P.S Case No. 158 of 2023.
