Mr. Krishna Chandra Ojha, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-07-2026 Heard learned counsel for the petitioners, learned A.P.P. for the State and learned counsel appearing on behalf of the informant.

2. The petitioners seek bail in a case registered for the offence punishable under Sections 103(1) and 3(5) of the B.N.S..

3. As per prosecution case, it is alleged that on 14.03.2025, these two petitioners came to the house of informant in an intoxicated condition and started abusing him. It is further alleged that when wife of informant objected, these

4. It is submitted by learned counsel for the petitioners that petitioners are quite innocent and have committed no offence. Petitioners have falsely been implicated in this case due to long standing enmity between the parties. Even as per F.I.R., these petitioners are not alleged to have assaulted rather only pushed the wife of informant due to which she fell down and died. There was no intention to cause hurt or kill the deceased. The doctor who conducted the post mortem of the deceased did not find any external injury on the body of the deceased. Charge-sheet has already been submitted and Petitioner No. 1 is in custody since 25.01.2026 and Petitioner No. 2 is in custody since 04.02.2026.

5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioners.

6. Considering the facts and circumstances of the case, general and omnibus nature of accusation and period of custody, the prayer for grant of bail to the petitioners is allowed.

7. Accordingly, let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the
