The petitioner apprehends his arrest in connection with Mansi P.S. Case No. 90 of 2016, registered under Sections 341, 323, 307/34 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that on 07.05.2016, when the informant Ram Pravesh Yadav was returning to his house from the field, he saw quarrel between Ram Khelawan Yadav and this petitioner. At that time, Sanjiv Yadav and this petitioner opened fire, but the same was missed. Thereafter, they assaulted him by means of iron rod. Learned counsel for the petitioner submits that, in fact, altercation took place in between the Mancheet Yadav, brother of the petitioner and Ram Khelawan Yadav in which informant of the present case rushed there and caused injury to Mancheet Yadav for which Mansi P.S. Case No. 92 of 2016 was also instituted under Sections
Patna High Court Cr.Misc. No.44522 of 2016 (2) dt.27-10-2016 2/2 147, 148, 149, 323, 307, 427 and 379 of the Indian Penal Code in which present informant is also accused. The petitioner being the brother of Mancheet Yadav has falsely been implicated in this case with false allegation of making firing. Moreover, the injury found on the person of the informant is simple in nature caused by hard and blunt substance.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria in connection with Mansi P.S. Case No. 90 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
