The petitioner is in custody since 28.05.2018 in connection with Paharpur P.S. Case No. 117/2018 registered for the offences punishable under Sections 147/148/149/341/323/ 324/354/307/379/504 of the Indian Penal Code. Subsequently, Section 302 of the IPC was added.

Earlier the bail application of the petitioner was rejected vide order dated 28.08.2019.

A report was called for from the Court of Additional Session Judge, III, East Champaran at Motihari regarding stage of Sessions Trial No. 481 of 2019 which is kept at flag 'A' to the petition.

From perusal of the report dated 13.11.2020, it

Patna High Court CR. MISC. No.28460 of 2020(3) dt.11-01-2021 2/2 appears that four witnesses have already been examined and the case is pending for further evidence.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to this petitioner, It is, accordingly, rejected.

However, taking into consideration the period of custody i.e., 28.05.2018, trial court is directed to expedite the trial.
