As prayed for, learned counsel for the petitioner is permitted to make correction in the name of the petitioner. Petitioner apprehends his arrest in connection with Mahua P.S. Case No. 375 of 2015 registered for the offences punishable under Sections 147, 148, 149, 353, 323, 333, 307, 342, 337, 338, 435 of the Indian Penal Code and Sections 3 / 4 of Essential Services Maintenance Act.
Allegedly, one Naresh Ram was killed then, mob of 200 people put the dead body on the road, blocked the traffic and made assault to the Police personnel by pelting stones. Submission is of false implication and that the accusation is against 200 mob and the petitioner has got no criminal
Patna High Court Cr.Misc. No.53745 of 2016 (2) dt.20-12-2016 antecedent, the mob was protesting against the murder of innocent person, hence, the Police in order to save his own skin lodged this case maliciously.
In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 375 of 2015, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
