The petitioners apprehend their arrest in connection with N.T.P.C. P.S. Case No.36 of 2020 registered for offences under Sections 341, 323, 324, 307, 379, 504 and 506/34 of the Indian Penal Code.
Petitioners are said to have assaulted the injured Dinesh Kumar with knife and screw driver. Dinesh Kumar sustained a number of injuries but most of the injuries have been found to be simple in nature. Opinion has been reserved with regard to two injuries, namely, injury nos. 5 and 8. Accordingly, let petitioners, above-named, in the event of their arrest or surrender within four weeks from today, be released on bail till submission of charge-sheet on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-V, Patna in connection with N.T.P.C. P.S. Case No.36 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and subject to further condition that if the injury report is submitted showing that the injuries sustained by the injured are simple in nature, then the anticipatory bail granted to the petitioners shall be confirmed by the Court below after submission of the chargesheet. If the injury report shows that the injuries sustained by the injured are grievous in nature, in such a situation, the bail bonds of the petitioners shall stand automatically cancelled and they shall be taken into custody forthwith.
