2. The petitioner is apprehending his arrest in connection with Noorsarai P.S. Case No. 285 of 2021, F.I.R. dated 21.08.2021 for the offences punishable under Sections 379 of the Indian Penal Code.

3. According to prosecution case, the informant suspects the involvement of the petitioner in stealing his tractor.

4. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He further submits that the allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R. The name of the

No.34788 of 2025(4) dt.30-07-2025 2/2 petitioner transpired merely on the ground that the tractor in question has been recovered in front of the house of the petitioner and for the same set of allegation Hilsa P.S. Case No.394 of 2021 was lodged against all family members including this petitioner also.

5. The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that the tractor in question has been recovered near the house of the petitioner and apart from that the petitioner carries four criminal antecedents other than the present one but fairly submits on the basis of paragraph-3 of the bail application that the petitioner is on bail in the pending matters.

6. Considering the aforesaid facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner in connection with Noorsarai P.S. Case No. 285 of 2021 pending in the court of Additional Chief Judicial Magistrate,VII, Nalanda.

7. Prayer is refused.
