JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-12-2022 Heard learned counsel for the petitioner and learned APP for the State and perused the case diary. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 323, 325, 307, 337, 353, 427, 504 and 506 of the Indian Penal Code and Sections 37(b) and (c) of the Bihar Prohibition and Excise Act.

Allegedly, it is a case of creating hindrance in discharge of the officials duties by the petitioner and other accused persons.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that there is general and omnibus allegation against the petitioner, petitioner has not been apprehended at

Patna High Court CR. MISC. No.28118 of 2022(3) dt.07-12-2022 2/2 the spot and no offence is make out against the petitioner. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Exclusive Special Excise Court, Saran at Chapra in connection with Sonepur P.S. Case No. 139 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
