Having regard to the fact that the petitioner has a grievance as with regard to his being not given the benefit of ACP, this Court without going into the merit of such grievance of the petitioner would simply direct the competent authority to consider such grievance of the petitioner and if it is found that the petitioner is entitled for grant of ACP as per ACP Rules-2003 and its amendment made from time to time, an appropriate
Patna High Court CWJC No.19607 of 2014 (2) dt.20-07-2015 decision for grant of ACP shall be taken only with others who are also similarly situated like the petitioner but if on the other hand it is found that the petitioner is not entitled for grant of ACP, for any valid reason, the competent authority shall pass a reasoned order and communicate the same to the petitioner. This Court hopes and believe that the aforesaid exercise will be completed within a period of six months from the date of receipt of this order.
With the aforementioned observation and direction, this application is disposed of.
