1. Heard the learned Advocate for the petitioners and the learned APP for the State.
2. The petitioners seek bail in connection with Sessions Trial No.760 of 2023 arising out of Ujiyarpur P. S. Case No.203 of 2023 instituted for the offences under Sections 376, 302 and 201 of the Indian Penal Code, but the charge has been framed under Sections 302 and 201 of the I.P.C.
3. The learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no.1 is in custody since 23.11.2023 and petitioner no.2 is in custody since 30.03.2024 and allegation is of rape and murder of the daughter of the informant.

4. The learned counsel appearing on behalf of the petitioners submits that petitioners are not named in the FIR and suspicion in the FIR is raised against Nitish Kumar and the name of the petitioners transpired in the confessional statement of Nitish which which does not have any evidentiary value.
5. The learned A.P.P. Sri Chandra Bhushan Prasad submits that trial has commenced and out of seven prosecution witnesses, six prosecution witnesses have been examined and only doctor remains to be examined, as such, the trial is on verge of conclusion. It is also submitted that the allegation alleged in the FIR is heinous.
6. Considering the submissions made by the learned A.P.P., the Court is not inclined to release the petitioners on bail.
