JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-11-2020 Heard learned counsel for the petitioner as well as learned counsel for the State through video conferencing. The petitioner seeks bail in Bhabua(Sonhan) Police Station Case No. 107/2020/Gr No.293/2020 registered for the offences punishable under sections 302/307 and other allied sections of the Indian Penal Code.

The informant in his FIR has alleged that on 18.2.2020 at about 9 am the petitioner and other accused persons, all named in the FIR, came to his house and on the order of accused Haridwar Chaurasiya, the petitioner hurled blow by Lohbanda (iron rod) on the head of informant's father. Accused Manoj Chaurasiya also assaulted him as a result of which he fell down on earth, thereafter all the accused persons assaulted him who died later on. Accused Sunita Devi took out his golden chain. Other family members of the informant were also assaulted by the accused persons.

Learned counsel for the petitioner submits that the petitioner and the informant are agnate and petitioner has also lodged Bhabua (Sonhan) Police Station Case No. 108 of 2020. Petitioner has got no criminal antecedent and he is in custody since 25.2.2020.

Learned counsel for the State opposes the prayer for bail and submits that there is allegation against the petitioner

Patna High Court CR. MISC. No.28466 of 2020(2) dt.11-11-2020 2/2 that he assaulted the victim with iron rod on his head. In view of the nature as well as the gravity of the offence alleged in the FIR, prayer for bail of the petitioner is refused.
