2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 341, 323, 385, 307, 427, 447, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case, in brief, is that on 26.04.2024 at about 4:30 PM, informant got information that this petitioner along with other F.I.R. named accused persons and 15-20 persons were demolishing boundary wall of the land of informant. When informant reached there, then this petitioner asked him to pay extortion money and upon refusal, the accused persons started indiscriminate firing. It is further alleged that the accused persons also damaged the scooty of the informant by means of lathi and stones and thereafter, they fled away from the place of occurrence.
4. Learned counsel for the petitioner submits that due
Patna High Court CR. MISC. No.28400 of 2025(2) dt.14-05-2025 2/2 to admitted land dispute, this false and concocted case has been lodged. As a matter of fact, informant is a land broker. He further submits that father of co-accused Ashok Bhagat executed power of attorney to one Suraj Kumar for the land measuring 44 katha. Informant purchased a land measuring 22 katha from Suraj Kumar knowing the fact that the said land is disputed and Title Suit No. 334/2010 is also pending between co-accused Ashok Kumar and Dr. Shravan and informant forcibly tried to take possession of the purchased land which was resisted by this petitioner and others. Moreover, dispute involves sale and purchase of land which is of civil nature.
5. However, learned A.P.P. for the State vehemently opposed the bail application and submitted that there is specific accusation that this petitioner and others demanded extortion and also demolished boundary wall of the land of informant. Petitioner has got two criminal antecedents.
6. Considering the nature of accusation and criminal antecedents, prayer for anticipatory bail of the petitioner is refused.
