1. Heard the parties.
2. The petitioners apprehend their arrest in connection with Naubatpur P. S. Case No. 462 of 2025 registered for the offence(s) punishable under Section(s) 329(3), 126(2), 115(2), 117(2), 76, 303(2), 352, 351(2) and 3(5) of the BNS.
3. The main submissions advanced by the learned counsel for the petitioners are that the petitioners are innocent and have been falsely implicated due to a dispute relating to right of passage (rasta) between the parties, who are neighbours. It is contended that the allegations made in the FIR
Patna High Court CR. MISC. No.28438 of 2026(2) dt.01-05-2026 2/3 are general and omnibus in nature and no specific overt act has been attributed to the petitioners. It is further submitted that the alleged occurrence has been exaggerated and injury sustained by the mother in law of the informant was due to her fall on account of old age and the present case has been lodged after two days with an ulterior motive to pressurize the petitioners in the civil dispute. It is also submitted that the petitioners are poor agricultural laboururs and the petitioner no.3 has clean antecedent while petitioner no.1 and 2 has one criminal antecedent each and both are on bail in the said cases.
4. Learned APP appearing for the State has opposed the bail prayer of the petitioners.
5. In the facts and circumstances of this case and considering the statements made in the petition as well as above submissions, coupled with the nature of dispute between the parties and general and omnibus nature of allegation, this court is inclined to the grant the relief of anticipatory bail to the petitioners. Accordingly, let the petitioners named-above, in the event of their arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail in connection with Naubatpur P. S. Case No. 462 of 2025 on furnishing bail bond of Rs. 20,000/- (Rupees
