ANJANA MISHRA ORAL ORDER 19-04-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 19.03.2019 in connection with Falka P.S. Case No.96 of 2019 registered for the offence under Section 30(a), 37(b) and read with Section 13 of the Bihar Prohibition and Excise Amendment Act. Learned counsel for the petitioner submits that 35 litres of illegal country-made liquor was recovered from the house, which is in the joint possession of the present petitioner and other persons and therefore, the entire claim had been saddled on his shoulders. It is further submitted that the present petitioner has no criminal antecedent.

Considering the aforementioned facts and

No.25607 of 2019(2) dt.19-04-2019 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge, Katihar in connection with Falka P.S. Case No.96 of 2019.
