JUSTICE AJAY KUMAR TRIPATHI ORAL JUDGMENT Date: 09-09-2016 Petitioner is well advised to expedite disposal of his R.C. case, numbered as R.C. Case No.43 of 1986. The respondent State authorities cannot be faulted for withholding of 10% of pension and gratuity keeping in view that criminal case is pending against the petitioner though it is an old case and it must reach its finality. No sooner the case is closed or decided, the petitioner can assert his right for grant of regular pension as well as gratuity. Rest of the claim of the petitioner has already been settled which is the stand of the State and not denied by the counsel for the petitioner.
