The petitioner apprehends his arrest in connection with Forbesganj P.S. Case no. 126 of 2016, registered under Sections 272, 273 of the Indian Penal Code and Section 47 (a) of the Bihar Excise Amendment Act.

Learned counsel for the petitioner submits that in course of checking one Tata Magic by the Police and on search 1056 of bottles containing 190.80 liters of India made foreign liquor was recovered. At that time, Matar Lal Chaurasia and Md. Abdul Rajjak were apprehended, who disclosed the name of the accused persons, including the petitioner, saying that four persons used to prepare the India made foreign liquor and petitioner and one Pradeep Bhagat used to sale the same. Except the confessional statement, there is nothing against the petitioner. The petitioner has no criminal antecedent.

No.54296 of 2016 (2) dt.22-12-2016 2/2 Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No.126 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
