JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-10-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Khagaul P.S. Case no. 150 of 2016, registered under Sections 341, 323, 504, 506, 354, 420, 406, 427 and 357/34 of the Indian Penal Code.

The accusation is that informant Vimla Kumari used to run shop in the night of 01.09.2013, the petitioner damaged the shop through JCB. When Police came there then written agreement was made to return the shop after constructing the house in spite of that shop was not returned. On 21.09.2016 in the evening petitioners came at the shop and started giving threatening to outrage the modesty and also gave threatening for dire consequence.

Patna High Court Cr.Misc. No.47056 of 2017 (2) dt.03-10-2017 2/2 Learned counsel for the petitioners submits that, in fact, informant was running the shop in the house of petitioner and on the permission of the Municipal Corporation, the shop was demolished, but due to ulterior motive the informant lodged the present case. On investigation, the Police submitted the Chargesheet against the petitioners.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M-V, Danapur, Patna in connection with Khagaul P.S. Case No. 150 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
