JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Dulhin Bazar P.S. Case No. 178 of 2015 registered under Sections-325, 307 & other minor sections of the Indian Penal Code and 27 of the Arms Act.

No doubt, there appears to be case and counter case between the parties and persons from both the sides sustained injury but there is specific allegation against the petitioner that he opened fire causing fire-arm injury on the right hand of the petitioner and, therefore, I do not feel it proper to extend the privilege of anticipatory bail to the petitioner and, accordingly, prayer for anticipatory bail in connection with Dulhin Bazar P.S.

Patna High Court Cr.Misc. No.42722 of 2016 (2) dt.22-11-2016 2/2 Case No. 178 of 2015 stands rejected.

However, this order shall not cause any prejudice to the competent court at the time of consideration of regular bail application of the petitioner.
