The petitioner seeks bail in anticipation of his arrest in connection with Patori P.S. Case No. 465 of 2019 dated 21.12.2019 instituted for the offences under Sections 307, 323, 324, 325/34, 341, 342, 379, 427, 504 and 506 of the Indian Penal Code.
The allegation against the petitioner is of having assaulted the informant of this case repeatedly. Learned counsel for the petitioner has submitted that even though the allegation is of repeated assault, the informant has received only one injury. Apart from this, it has been pointed out that the occurrence took place on 17.12.2019 when the
Patna High Court CR. MISC. No.25657 of 2020(4) dt.19-01-2021 2/2 informant was immediately examined by the doctor but the FIR appears to have been registered only on 21.12.2019. Surprisingly, the injury report has been signed by the doctor on 1105.2020.
Considering the aforestated facts, this Court is inclined to grant anticipatory bail to the petitioner. By order dated 13.10.2020, the petitioner was granted provisional bail during the pendency of this petition.
The anticipatory bail petition of the petitioner is allowed. The petitioner shall remain on the same bail bonds.
The petition stands disposed of accordingly.
