Of course, in the present writ petition, the petitioner, besides making prayer for directing the private Respondent to make payment of rent in view of order of the House Controller, has also made a prayer for directing the appellate authority to decide the appeal, which has been preferred by private Respondent i.e. Respondent no.2 against the order of the House Controller. However, at the time of hearing of the present writ petition, a limited prayer was made by learned counsel for the petitioner for disposal of the present writ petition with a direction to the appellate authority i.e. the District Collector, Patna to take

Patna High Court CWJC No.7442 of 2014 (2) dt.07-08-2015 2/2 appropriate steps for early disposal of B.B.C. Appeal no.37 /2012. Since a limited prayer has been made by learned counsel for the petitioner for disposal of the aforesaid appeal, the Court is of the opinion that without directing for issuance of notice to the private Respondent, the writ petition can be disposed of . Accordingly, the writ petition stands disposed of with expectation that the learned Collector, Patna , who is the appellate authority in respect of B.B.C. Appeal no.37 of 2012, may take appropriate steps so that hearing in the appeal may come to its logical end without unnecessary delay preferably within three months from the date of receipt/production of a copy of this order.
