2. The petitioner has preferred this application for grant of regular bail in connection with Panchmahla P. S. Case No. 4 of 2025 registered for the offences punishable under Sections 191(2), 191(3), 190, 223(A), 132, 109(1), 352, 351(2) of B.N.S and Section 27 of Arms Act.

As per prosecution case, in short, is that on alleged date of occurrence the informant (SHO, Pachmahala Police Station) got an information that one Sonu and Monu have locked the house of one Mukesh Kumar Singh in connection with some monetary dispute and for verification of the same he (informant) reached the place of occurrence at about 3:15 P.M. and found that the main gate of the house of Mukesh Kumar

No.28570 of 2025(2) dt.29-05-2025 2/3 Singh was locked and the informant in the presence of local people was trying to get the lock open but in the meanwhile, the petitioner along with his 15-20 supporters came on the spot and said the informant (SHO) to leave the place and that he would resolve the matter himself and thereafter opened the lock of the said house and left the place of occurrence. The informant was taking the application of said Mukesh Kumar Singh and in the meanwhile, he got information that the petitioner had gone to the house of said Sonu and Monu in village Nauranga under P.S. Pachmahala and the informant immediately proceeded for Nauranga and on his way when he was about to reach the house of said Sonu and Monu, he heard the sound of firing and when he came nearer he saw the petitioner along with his supporter left the place of occurrence.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is apparently clear from the FIR itself that only oral allegation of threatening has been levelled against the petitioner except this there is no allegation at all against the petitioner. He submits that after perusal of the contention of the FIR there is no such allegation that the petitioner has either assaulted the informant or used criminal force to deter the public servant
Patna High Court CR. MISC. No.28570 of 2025(2) dt.29-05-2025 3/3 during course of discharging his official duty. Petitioner is languishing in jail since 24.01.2025.
5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

During course of argument learned counsel for the petitioner submits that after completion of investigation chargesheet has been submitted against the petitioner and there is no specific allegation of firing against the petitioner nor anyone has been injured in this case. But, still charge-sheet has been submitted under Section 109 of BNS. He also submits that no case under Section 109 of BNS is made out.
7. Keeping in view the aforesaid facts and considering the lack of any injury to anyone and period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Class, Patna in connection with Panchmahla P.S. Case No. 4 of 2025.
