The petitioner apprehends his arrest in connection with Vishwambharpur P.S. Case No. 73 of 2017 registered for the offence punishable under Sections 414/34 of the Indian Penal Code.
Informant is the A.S.I who in his written report has stated that during patrolling duty accused Hira Lal Yadav was apprehended with a stolen motorcycle who could not produce any document, regarding said bike and disclosed the name of petitioner as his accomplice who managed to escape. It has been submitted on behalf of the petitioner that the petitioner has committed no offence and has been falsely
Patna High Court Cr.Misc. No.27837 of 2018(2) dt.09-05-2018 2/2 implicated in this case by Hira Lal Yadav due to enmity. It has been further submitted that petitioner was at Sitamarhi on the date and time of occurrence and nothing incriminating has been recovered from his possession. Petitioner has got no criminal antecedent.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateV, Gopalganj in connection with Vishwambhapur P.S. Case No. 73 of 2017, and subject to the condition as laid down under Section 438(2) of the Cr.P.C.
