The grievance of the petitioner is that in running of the office of the District Agriculture Officer, Bhagalpur he had spent money to the tune of Rs.1,26,382/-. It is the submission of learned counsel for the petitioner that of the said amount, a sum of Rs.18,969/- has been paid to the petitioner through cheque on 31.3.2014 and a further sum of Rs.49,990/- has been paid subsequently. He thus submits that as against the pending dues the petitioner has received payment of Rs.68,959/- but the balance amount of Rs.57,423/- yet remains pending for payment. Learned counsel for the petitioner in support of his submission that the said amount had been spent over the office
Patna High Court CWJC No.430 of 2016 dt.06-02-2018 expenditure has relied upon the noting of the District Agriculture Officer, Bhagalpur at Annexure 2 to the writ petition. Having heard learned counsel for the parties and considering the nature of grievance raised, I hereby direct the District Agriculture Officer, Bhagalpur to consider the grievance of the petitioner subsisting as regarding the payment of balance amount of Rs.57,423/- and dispose of the same in accordance with law within a period of 3 months from the date of receipt/production of a copy of this judgment.
Needless to add that in case the petitioner is found entitled to the said amount the same should be paid to him within the same period and in case of any dispute the same should be disposed of by a speaking order to be passed within the same period.
