No one appears for the State to oppose this application. Petitioner is seeking anticipatory bail in connection with Special Case No.3745/2018, arising out of Bihta P.S. Case No. 395 of 2018, registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. It is stated that the recovery is made from a place which does not belong to this petitioner. The petitioner has no criminal antecedent and co-accused, Godhari Yadav, Om Prakash Yadav and Khushi Lal Yadav have already been granted privilege of anticipatory bail by coordinate Benches of this Court in Cr.Misc.No. 15712/2019, 24980/2019 and 10295 of 2019. Case No. 395 of 2018, subject to the condition prescribed under Section 438(2) of the Cr.P.C.
