2. The petitioner is in judicial custody in connection with Kharagpur P.S. Case No. 378 of 2024 for the offence punishable under Sections 103(1) and 3(5) of Bhartiya Nayay Sanhita, 2023 lodged on 11.12.2024 by the informant, Saket Kumar Singh.
3. As per the prosecution story, the informant alleged that his cousin brother came from his in-laws' house, went outside but failed to return. Later, his dead body was found in a pond and allegation is that there was heated conversation earlier with the petitioner, the name came up. This led to the FIR.
4. In this case, a coordinate bench had called for the case diary which is on record alongwith the post-mortem report.
5. Learned counsel for the petitioner submits that both

No.30453 of 2025(3) dt.06-08-2025 2/3 were addicted to alcohol, the deceased on his own fell into the pond, it is the case of accidental death but only because there was heated conversation earlier, he stands implicated and there is no eye-witness to the said occurrence in the entire village. He is in custody since 11.12.2024 having no criminal antecedent.
6. Learned APP has taken this Court to the case diary to show that earlier there was heated conversation between both of deceased and the petitioner, they had threatened each other of dire consequences.
7. Considering the submissions of the parties as also the fact that there is no eye-witness to the occurrence, he is in custody since 11.12.2024 having no criminal antecedent, this Court is inclined to extend him the privilege of bail with conditions.
8. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st Munger, in connection with Kharagpur P.S. Case No. 378 of 2024 subject to the following conditions: (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his bona fide;
Patna High Court CR. MISC. No.30453 of 2025(3) dt.06-08-2025 3/3 (ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;
(iii) the petitioner shall appear before the concerned police station every fortnight for next six months to mark his attendance;
(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;
(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) Ravi/- U T
