11-01-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending her arrest in connection with Dalsingsarai P.S. Case no. 132/2008 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code.

Learned counsel for the States submits that after perusal of case diary it appears that though allegation has been made against the brother-in-law of the deceased lady under Section 304B. The case diary does not reveal any specific allegation against her. He submits that there are many allegations against the husband of the deceased.

Considering the aforesaid facts and circumstances and

Patna High Court Cr.Misc. No.24044 of 2015 (4) dt.11-01-2016 2/2 that no specific allegation is made against the mother-in-law of the deceased lady, let the petitioner, Janki Devi, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Dalsingsarai, Samastipur in connection with Dalsingsarai P.S. Case No. 132/2008, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
