The petitioner apprehends his arrest in connection with Sikandra P.S. Case No.91 of 2015 registered under Sections 302 and 201/34 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that on the recovery of the dead body of Jagan Yadav alias Jago Yadav, the husband of the informant, the present case was lodged on the basis of her fardbayan on 25.07.2015. Later on, on the same day, Mukesh Yadav, son of the informant also filed written statement before the Officer Incharge, Sikandra (Jamui), to the effect that his father Jagan Yadav had illicit relation with Jasho

Patna High Court Cr.Misc. No.44283 of 2016 (2) dt.22-10-2016 2/2 Devi and, as such, he raised suspicion that Jasho Devi, her husband Sadhu Yadav, son Ratan Yadav and her other family members have committed the murder of his father. In course of investigation, the police got recorded the confessional statement of Jasho Devi, who also raised suspicion against the petitioner and others of having their hands in the murder of the husband of the informant due to land dispute. Except suspicion raised by Jasho Devi, there is nothing to connect the petitioner in the commission of the alleged offence.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Jamui,in connection with Sikandra P.S. Case No.91 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
