These are matters of accounting against advances. It is surely upon the petitioner to render accounts and satisfactory evidence of utilization of the advances given to him. In absence of the same, if order of recovery has been effected against the petitioner, no interference is warranted. The explanation offered by the petitioner does not satisfy this Court. If such an explanation is allowed, then it will only encourage financial indiscipline, because every government servants will have some explanation to offer for non-accounting to the advances, which have been taken by them or not reconciling or producing evidence thereof.
Patna High Court CWJC No.13033 of 2015 dt.11-01-2016 2/2 Writ application is dismissed with liberty to the petitioner as above.
