JUSTICE BIRENDRA PRASAD VERMA ORAL ORDER -------------- 26-08-2015 When the matter has been taken up, a show cause is being filed on behalf of the opposite party no.2 stating therein that in compliance of the order dated 05.04.2013 passed in CWJC No. 5508 of 2013, the petitioner did not appear before the opposite party no.2 within the time prescribed.

Learned counsel appearing on behalf of the petitioner has not been able to dislodge the aforesaid submission/averment. Since the petitioner himself has not complied the order dated 05.04.2013 passed in CWJC No. 5508 of 2013 (Annexure-1), there is no question of committing contempt of court by opposite party no.2.

In above view of the matter, the present contempt

Patna High Court MJC No.1608 of 2014 (2) dt.26-08-2015 2/2 application appears to be completely misconceived and is, accordingly, dismissed.
