JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-07-2025 Heard learned senior counsel appearing on behalf of the petitioners, learned A.P.P. appearing on behalf of the State and learned counsel appearing on behalf of the informant.

2. After some arguments, learned senior counsel for the petitioners seeks permission to withdraw the anticipatory bail application on behalf of Petitioner No. 1, namely Pramod Kumar.

3. Permission, as prayed for, is accorded.

4. Accordingly, this anticipatory bail application on behalf of Petitioner No. 1 stands dismissed as withdrawn.

5. Petitioner No. 2 apprehends his arrest in a case registered for the offence punishable under Sections 191(2),

Patna High Court CR. MISC. No.26205 of 2025(5) dt.23-07-2025 2/3 126(2), 115(2), 118, 303(2), 109, 352 and 351(2) of the B.N.S..

6. As per prosecution case, this petitioner, along with co-accused Sujeet, is alleged to have assaulted one Sunny by means of sword.

7. It is submitted by learned senior counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence. Doctor has found the injuries allegedly caused by this petitioner to be simple in nature. There is case and counter-case between the parties.

8. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

9. Considering the nature of accusation, case and counter-case between the parties and nature of injuries allegedly caused by this petitioner, the prayer for grant of anticipatory bail to the Petitioner No. 2 is allowed.

10. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named Petitioner No. 2 be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Judge-Ist, Vaishali, Hajipur in connection with Jandaha P.S. Case No. 410 of 2024, subject to condition as laid down under Section 482(2) of the

11. With the aforesaid directions, this application stands disposed of.
