JUSTICE AJAY KUMAR TRIPATHI ORAL ORDER 17-09-2016 From the counter affidavit it is evident that the petitioner is facing three departmental enquiries including a vigilance case. That is the reason why his final pension and post retrial dues is not being authorized and sanctioned. Whatever be the reason which led to such initiation, in the opinion of the Court no final settlement can be made in favour of the petitioner till such issues are sorted out.
Counsel for the petitioner, on instruction, informs the Court that the petitioner has been exonerated in some of the matter
Patna High Court CWJC No.18870 of 2015 (2) dt.17-09-2016 and the rest are on the way.
No sooner petitioner stands exonerated of the charges before the authorities, it will be incumbent upon the competent authority to ensure that final settlement of the petitioner is made with regard to his post retrial dues.
