====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-10-2020 Heard the parties through the virtual court proceeding. The petitioner seeks bail in connection with Gurua P.S. Case No. 48 of 2015 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. As per F.I.R., the informant alleged that Vinod Kumar, father-in-law of Vinod Kumar and Anil Kumar entered into her house locked the informant and others in a room and assaulted Surji Devi, the mother of the informant and strangulated her to death.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. He further submits that the petitioner has got no any criminal antecedent and petitioner is in jail custody since 10.01.2020. Learned counsel for the petitioner further submits that the brother-in-law of the petitioner namely Anil Kumar lodged an F.I.R. against the informant Sunita Devi's husband namely Ravindra Mahto for the murder of his mother who has been convicted and sentenced on 24.02.2015 in Sessions Trial

Patna High Court CR. MISC. No.24114 of 2020(3) dt.19-10-2020 2/2 No.62 of 2013/194 of 2013 arising out of Rafiganj P.S. Case No.189 of 2012 by the Court of Ad-hoc Additional Sessions Judge-IV, Aurangabad for offences under Section 302/34 I.P.C. Soon after, the conviction and sentence of her husband on 24.02.2015, the informant has lodged a false case and implicated the petitioner for the revengeful action. Learned counsel for the petitioner further submits that there is general and omnibus allegation against the petitioner. Learned A.P.P. for the State opposed the bail petition. I have gone through the record including the case diary.

In the facts and circumstances of the case, let the above named petitioner be enlarged on bail after framing of charge on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sherghati, Gaya in connection with Gurua P.S. Case No. 48 of 2015.
