Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Chanpatia P.S. Case No. 296 of 2020 lodged under Sections 341, 323, 307, 385, 387/34 of the I.P.C. and 27 of the Arms Act. Learned counsel for the petitioner submits that this case was earlier rejected on 21.10.2021 passed in Cr. Misc. No. 18525 of 2021.

Learned counsel for the petitioner submits that he is not arguing in this case on merit rather intimating this Court that there were 5 accused persons, who were accused in this case and out of 5 accused persons, 4 persons were granted bail by the

Patna High Court CR. MISC. No.28491 of 2022(3) dt.15-11-2022 2/2 order of the Court. He further submits that petitioner is in custody since 17.08.2020.

Progress report of the case has been called for, from which it transpires that this case is committed on 04.07.2022. Case file has been received in the Trial Court on 14.07.2022. The case has been fixed for framing of charge. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail. Direction is hereby given to the Trial Court to expedite the case, preferably within 6 months. If trial is not concluded within 6 months, the Trial Court is directed to release the petitioner on bail imposing its own conditions, so that he may not evade his appearance during trial.

With this observation, the bail application stands rejected.
