Petitioner apprehends his arrest in a case registered for the offence punishable under section 7 of the Essential Commodities Act.

It is contended on behalf of the petitioner that he was merely weighing the foodgrains at the instruction of the Chairman and office bearers of the concerned PACS. It is next contended that the chairman of the PACS, namely, Md. Kamruzaman alias Kamruzaman, has already been granted anticipatory bail by a Single Judge Bench of this Court vide order dated 07.12.2015 passed in Criminal Miscellaneous No. 42768 of 2015. No.1090 of 2016 (2) dt.12-01-2016 abovenamed petitioner, namely, Afsar Imam, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Shikarpur Police Station Case No. 317/2015 on furnishing bail bond of Rs.10,000/- ( Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
