The petitioner is apprehending his arrest in connection with Lauria P.S. Case No. 127 of 2016 for the offences instituted under Sections 341, 323, 354(B) and 506 of the IPC. The prosecution story, in brief, is that while the informant's daughter went for natural call, this petitioner with illegal intention started manhandling to her. Somehow, she tried to escape from there but this petitioner torn her clothes. Saryug Chaudhary saved her. While the informant went for making complain to the house of this petitioner, the family members became adamant to commit mar-pit with her.
Patna High Court Cr.Misc. No.51881 of 2016 (2) dt.07-12-2016 2/2 It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. From perusal of the order of the learned Sessions Judge, it would appear that the independent witnesses in course of investigation have not supported the prosecution case.
On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Lauria P.S. Case No. 127/2016 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-Ist, West Champaran at Bettiah, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
