The petitioner is in custody in connection with Tharthari P.S. Case No. 25 of 2019 for the offenses under Sections 406, 420/34 of the Indian Penal Code. Learned counsel for the petitioner would submit that petitioner has no criminal antecedent. Allegation against the petitioner is that after receiving money the petitioner has not executed the sale deed. Counsel further submits that the dispute of such nature can appropriately be considered in civil proceeding. The petitioner is in custody since 21.2.2019.
