This application under Section 482 of the Code of Criminal Procedure has been filed for modification of the order dated 27.3.2015 whereby in the event of arrest or surrender within six weeks, the petitioners were directed to be released on bail in connection with Kotwa P.S. Case No. 244 of 2013. The petitioners did not appear before the court below in order to furnish bail bond over a period of nine months and, thereafter, the instant application has been filed for modification of the order, on 15th November, 2016.
I see no merit in the application. Accordingly, the
Patna High Court Cr.Misc. No.49238 of 2016 (2) dt.23-11-2016 2/2 application is dismissed.
In case the petitioners surrender within two weeks from today and seek bail, the court below apart from the grounds which the petitioner may take, shall also take into consideration the fact that earlier this Court had granted the privilege of prearrest bail to the petitioners which they did not avail due to their own conduct.
