2. This is an appeal against acquittal filed in the year 2021. In the initial order dated 21.08.2021, the appellant was directed to file a supplementary affidavit annexing certified/xerox/true copy of the deposition of the witnesses examined and documents exhibited during trial. But, no such compliance was made. Subsequently, on the prayer made by

Patna High Court CR. APP (DB) No.460 of 2021(4) dt.11-12-2025 2/2 counsel for the appellant, further time was granted vide order dated 13.02.2023. Till date, the said order was not complied with. Moreover, the defects mentioned by the Stamp Reporter in Defect no.6(1) to 6(7) have not been removed.

3. The learned Advocate on behalf of the appellant is not present today. And no accommodation has been sought for on behalf of the appellant.

4. In view of such circumstance, we find that the memorandum of appeal is defective and accordingly, the present Cr. Appeal (DB) No.460 of 2021 is hereby dismissed. (Bibek Chaudhuri, J) (Dr. Anshuman, J) Divyansh/- U
