In this case, the petitioner is apprehending his arrest in connection with Marhowrah P.S. Case No. 364 of 2017 registered for offences under sections 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act. As per allegation made in the First Information Report, the brother of the Informant, namely, Jitendra Singh was working with Munna Singh, who is running a racket for appointment in the Army. The deceased and other accused persons were working as an agent in connection with the examination of B.S.S.C. where forgery was committed. In that connection, Munna Singh was sent to jail, when he came out, he got suspicion that he was being arrested by the brother of the

Patna High Court Cr.Misc. No.26606 of 2018(2) dt.03-05-2018 2/2 Informant. The victim was called by Munna Singh for negotiation and settlement of the dispute, when the victim gone there, he was killed by the accused person.

Learned counsel for the Informant submits that the petitioner was working as a liner whereas the order of the learned Sessions Judge shows that it is the petitioner who has supplied the gun.

Looking to the entire facts and circumstances of the case, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail of the petitioner, namely, Jagdish Yadav @ Jagdish Kumar Singh is rejected.
