Heard both parties.

The petitioner seeks bail in Patrakar Nagar P.S. Case No. 300 of 2020, registered for the offence punishable under Sections 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

The informant is police official. It is alleged that while he along with others was on patrolling duty reached near south Golamber ATM of SBI, then they saw that some persons after seeing them were trying to flee away, but one person was apprehended by them and one person fled away. Petitioner was present in the ATM cabin. On search, from possession of this

No.28348 of 2020(2) dt.10-11-2020 2/3 petitioner cash of Rs. 50,000/- and three ATM cards of Madhya Bihar Gramin Bank were found and from possession of another co-accused Pintu Kumar cash of Rs. 54,000/- and two ATM cards of Madhya Bihar Gramin Bank were found. It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case merely on suspicion. Petitioner is innocent. Nothing has been recovered from possession of this petition. Petitioner is in custody since 01.06.2020 having clean antecedent as stated in para 3 of the bail petition.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VIII, Patna in connection with Patrakar Nagar P.S. Case No. 300 of 2020, subject to following conditions:- (i) The petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and in the event of failure on two consecutive dates without sufficient reasons, his bail bond shall be liable to be
