JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-04-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Mokama P.S. Case No. 28 of 2017 registered for the offences punishable under Sections 307, 147, 148, 149, 326, 504, 506 and 341 of the Indian Penal Code and section 27 of the Arms Act. Petitioner is named in the first information report and the only allegation against him is that he instigated the other accused as a result where of co-accused Nitish Kumar, opened fire on the father of informant.

Learned counsel for the petitioner drew my attention towards Annexure-3 to the petition and submits that having more or less, similar allegation, co-accused Anmol Kumar and Ramlal

Patna High Court Cr.Misc. No.23938 of 2018 (2) dt.25-04-2018 2/2 @ Ramlal Kumar have already been granted privilege of anticipatory bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties and also with a view to maintain parity of justice, let petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Barh in Mokama P.S. Case No. 28 of 2017 subject to condition as laid down under Section 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) N.K/- U
