In this case, the petitioner is seeking regular bail in connection with N.D.P.S. Case No. 9 of 2018 arising out of Barahara P.S. Case No. 377 of 2018 registered for offence punishable under sections 8 (c), 20 and 29 of the Narcotic Drugs and Psychotropic Substance Act, 1985.

The petitioner has a criminal antecedent of same nature and he has been found to be carrying Heroine which is a very dangerous which was recovered by the police. The petitioner had earlier moved before this Court in Cr. Misc. No. 54837 of 2019 and this Court rejected the same vide order dated 20.11.2019.

From the record it appears that the petitioner was

Patna High Court CR. MISC. No.24680 of 2020(3) dt.29-01-2021 2/2 possessing 700 grams Paracetamol, 920 grams Heroine like substance, 100 grams Brown powder like substance, 40 grams Brown granular substance, 30 grams while powder like substance, which were recovered from the petitioner. Learned counsel for the petitioner submits that the petitioner is in jail custody since 21.09.2018 and he has not moved substantially.

Looking to the nature of allegation and past history of the petitioner, this Court is not inclined to grant bail to the petitioner and accordingly his prayer for bail is rejected. (Shivaji Pandey, J) Mahesh/- U T
