JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-01-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Goraul P.S. Case No. 118 of 2017 registered under Section 306/34 of the Indian Penal Code.

The allegation of informant, Jaimanti Devi, is that his daughter, Sangita Devi, aged about 19 years, was taken before two months by Renu Devi (petitioner), Jyoti Thakur, Hemansu Thakur and Sudhansu Thakur from her house, regarding which, F.I.R. was lodged. Before 3 to 4 days Renu Devi (petitioner) used to taunt her daughter due to that reason she committed suicide on 23.05.2017.

Learned counsel for the petitioner submits that, in fact,

No.1249 of 2018 (2) dt.11-01-2018 informant of the present case used to quarrel with her daughter due to that reason her daughter moved to the house of her sister, regarding which, petitioner and others named in the F.I.R. being the neighbour of the informant made protest then earlier informant lodged the case implicating the petitioner having hand in the kidnapping of her daughter. While daughter of the informant returned in the house. Then petitioner availed the privilege of prearrest bail due to that reason after committing suicide by the daughter of the informant the present case has been lodged with false allegation.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Goraul P.S. Case No. 118 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
