Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in Khirimore P.S. Case No. 24 of 2020, registered for the offences punishable under Sections 341, 323, 307, 120(B) and 34 of the Indian Penal Code and section 27 of the Arms Act.

Prosecution case in brief is that on 25.02.2020 at 13.30 hours while the informant was coming out of post office, co-accused Narendra Kumar Singh fired upon her, causing injury to her. Petitioner is alleged to have accompanied the coaccused.

Patna High Court CR. MISC. No.24529 of 2020(2) dt.06-10-2020 2/2 It is submitted that petitioner has been falsely implicated in this case. This false case has been lodged only to put pressure on the petitioner, as a partition suit bearing no. 117 of 2016 is pending between the informant and the co-accused person and petitioner is a witness in that case. There is no specific allegation against him.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Danapur in connection with Khirimore P.S. Case No. 24 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
