JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-09-2016 Heard learned counsels for the petitioner and the State. The petitioner being husband of the complainant is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken under Section 498A of the Indian Penal Code.
The basic accusation is of torture.
It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant. On joint prayer of the parties, the matter was referred to Mediation. The report of the Mediator at Flag C dated 17.8.2016 reflects that the issue could not be resolved between the parties through the
Patna High Court Cr.Misc. No.56947 of 2015 (5) dt.05-09-2016 2/2 process of mediation. It is further submitted that the petitioner is not ready to keep the complainant as wife. However, learned counsel for the complainant submits that the complainant is ready to resume the conjugal life.
Considering the stand of the petitioner, let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Complaint Case No. 2715 of 2012 pending in the court of learned SDJM, Saran at Chapra.
This application is disposed of with the aforesaid observation/direction.
