The petitioner is apprehending his arrest in connection with Bagen Gola P.S. Case No. 74 of 2015 for the offences instituted under Sections 379 and 408 of the Indian Penal Code. The allegation against the petitioner is that 34 bags of Cement and a Tullu Pump of the informant is said to have been stolen by the petitioner.

It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been named in the F.I.R. merely on the basis of suspicion. There is no other substantive evidence to suggest his implication in the present case.

Considering the aforesaid facts and circumstances, let the petitioner above named be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Bagen Gola P.S. Case No. 74 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-1st, Buxar, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
