JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-04-2018 Heard the learned counsel for the petitioners as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioners apprehend their arrest in connection with (Chanapatia O.P.) Sirisia P.S. Case No. 46 of 2018 for the offences punishable under sections 447, 341, 342, 323, 324, 354 (A), 354 (B), 379, 504, 506 and 34 of the I.P.C.
In the FIR against petitioner no.1 there is allegation for assaulting with Butt of Tangi on the head of the informant and against petitioner no.2 there is allegation for bringing the informant in the room with bad intention and caused injury in her breast with nail.
Patna High Court Cr.Misc. No.24435 of 2018 (2) dt.25-04-2018 2/2 Submission is of false implication and that the case has been compromised, the informant and her husband have signed the compromise petition and further both have filed petition for permitting them to compromise the case and as such the petitioners deserve sympathetic consideration. The learned A.P.P. submits that the informant and her husband have entered in to the compromise with the accused persons.
In the facts and circumstances stated above, the petitioners, in case of their arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M, Bettiah, West Champaran in connection with the aforementioned case, subject to the conditions as laid down under section 438 (2) of the Cr.P.C.
