Petitioner seeks bail in connection Patepur P.S. Case no. 167 of 2020 registered for the offence punishable under sections 399. 402, 414 of the Indian Penal Code read with sections 25(I-b)a and 26 of the Arms Act.
Learned counsel for the petitioner submits that petitioner is in custody since 19.01.2021 and charge sheet has been submitted. Learned counsel further submits that as per FIR allegation is that one country made loaded pistol and two live cartridges were recovered from accused Shyam Kumar who disclosed the name of the petitioner who fled away seeing the police with other co-accused. Learned counsel submits that admittedly, petitioner was not apprehended at the spot and his
Patna High Court CR. MISC. No.37683 of 2021(2) dt.08-12-2021 2/2 name has come in the confessional statement of Shyam Kumar and nothing has been recovered from his possession. Learned APP opposes the prayer for bail.
Considering the facts that petitioner is in jail custody and charge sheet has been submitted, the petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in Patepur P.S. Case no. 167 of 2020.
